Terms of service for the D&J Towing website and text alerts

"D&J Towing," "we," "us" and "our" mean D&J Towing & Recovery of Colorado Inc, doing business as D & J Towing, a family-owned towing and recovery company at 30495 Bryant Dr, Evergreen, CO 80439. "You" means anyone who visits this website or signs up for our text alerts.

These terms cover two things: your use of www.djtowingandrecovery.com, and the D&J Towing text alerts program described in section 6. They do not replace any separate paperwork, work order or agreement you sign or accept for a specific tow, recovery, haul or storage job.

By using this website, you agree to these terms. By joining D&J Towing text alerts, you also agree to the text message terms in section 6. If you do not agree, please do not use the site or join the program. You can still reach us by phone at any hour.

You must be at least 18 years old, or have a parent or guardian's permission, to request service or join our text alerts.

You may browse this site, read it, and share links to it for personal or business purposes. When you use it, you agree not to:

• Submit a false service request, a prank call request, or information about a vehicle or person that you know is untrue.
• Use someone else's name, phone number or email address without their permission.
• Try to break, overload, scan or gain unauthorized access to the site or the systems behind it.
• Copy large parts of the site, or collect its content with automated tools, to build another site or product.
• Use the site in any way that breaks a local, state or federal law.

We may limit or block access for anyone who misuses the site.

The pages on this site describe our services, the areas we cover and how we work, in general terms. They are not a quote, an estimate, or a promise that a particular truck, service or arrival time will be available for your situation. Every job depends on things like the vehicle, its location, the road and weather conditions, safety at the scene and the equipment needed.

This website does not publish prices. Any price or estimate for a job comes directly from D&J for that specific job. We work to keep the site accurate and current, but details can change, and the information you get from our dispatch on the phone controls over anything written here.

The fastest way to request a tow or roadside help is to call (303) 674-0198, any hour of any day. Sending us an email or a message through the website is a request, not a booking. A job is accepted only when D&J confirms it with you.

The towing, recovery, roadside, hauling or storage work itself is governed by the terms agreed for that job and by applicable Colorado and federal law, not by this website. Questions about a vehicle held at our yard are answered on our impounds and release information page.

This section is the full set of terms for our SMS program. It applies to every text message we send you through the program.

6.1 Joining the program

You join D&J Towing text alerts only when you give us your mobile number and agree to receive text messages from us, for example by checking a text message consent box on one of our website forms or by telling us when you request service that you want text updates. Agreeing to receive texts is not a condition of buying any service. You can request a tow or roadside help by phone without ever joining.

6.2 What we send

The program sends service updates, dispatch and appointment messages, such as confirming that a request was received, letting you know a truck is on the way, or following up on a scheduled pickup, haul or release. Message frequency varies. Message and data rates may apply, based on your mobile plan with your wireless carrier.

6.3 Canceling and getting help

Reply STOP to cancel, HELP for help. After you reply STOP, we will send one message confirming that you have been unsubscribed, and you will not receive further program messages unless you join again. If you reply HELP, we will send a message with our contact details. You can also call us at (303) 674-0198 or email djtowing699@gmail.com for help or to be removed.

6.4 Delivery

Text delivery depends on your wireless carrier, your device and your signal, which can drop in canyons and other mountain areas. Carriers are not liable for delayed or undelivered messages. Because a text can arrive late or not at all, never rely on a text message for an emergency. Call us instead, or call 911 when anyone is in danger.

6.5 Your number and your privacy

Please tell us if you change or give up the mobile number you enrolled, so texts about your service do not reach someone else. How we collect, use and protect your mobile number and your text messaging consent is explained in our Privacy Policy, linked above.

The text, photos, logo, page designs and other content on this site belong to D&J Towing or are used with permission. The D&J Towing name and logo identify our company. You may not copy, sell or reuse them, or present them in a way that suggests we endorse another business, without our written permission. Sharing a link to one of our pages is always fine.

Some pages link to or display content from other companies, such as Google reviews, Google Maps, Facebook and Yelp. Those sites are run by their owners under their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices. Reviews shown on this site are the words of the people who wrote them.

This website and the text alerts program are provided "as is" and "as available." To the extent the law allows, we make no warranties of any kind about the site or the program, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available, free of errors or free of harmful code, or that every text message will be delivered.

Nothing in this section limits any warranty or right that Colorado or federal law gives you and that cannot be waived.

To the extent the law allows, D&J Towing and its owners, employees and contractors are not liable for indirect, incidental, special or consequential damages arising from your use of this website or the text alerts program, or from your inability to use them. This section applies to the website and the text program only. It does not change the terms that apply to a tow, recovery, haul or storage job, and it does not limit any liability that cannot be limited under Colorado law.

You agree to cover D&J Towing for claims, losses and reasonable costs, including attorney fees, that result from your misuse of this website or the text alerts program, from information you knowingly submit that is false, or from your breaking these terms.

These terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute about these terms, this website or the text alerts program will be heard in the state or federal courts located in Colorado, and you and D&J Towing agree to the jurisdiction of those courts. If a court finds part of these terms unenforceable, the rest stays in effect.

We may update these terms from time to time. When we do, we will post the new version on this page and change the effective date at the top. Changes apply from that date forward. If a change affects the text alerts program in a material way, we will tell program members by text or another reasonable method. Continuing to use the site or the program after a change means you accept the updated terms.
